These Terms govern your access to and use of Kasava (the “Service”). By using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.

Accounts & Eligibility

- You must be at least 16 years old to use the Service.

- Keep your credentials secure; you are responsible for activity under your account.

- Provide accurate information and comply with applicable laws.

Customer Data & License

- You own your content (code, documents, messages, and related data) (“Customer Data”).

- You grant us a worldwide, non‑exclusive license to host, process, and display Customer Data only to provide the Service, maintain security, and comply with law.

- We may generate de‑identified/aggregated metrics to improve the Service. We do not sell personal data.

Integrations & Third‑Party Services

- You may connect third‑party services (e.g., GitHub, Linear, Jira, Slack, Google Drive, Notion). You authorize us to use OAuth tokens to access data strictly as instructed.

- Third‑party terms and privacy policies apply to their services. We are not responsible for their acts/omissions.

- You can revoke access at any time from either Kasava or the third‑party service.

AI Features

- AI outputs can be incomplete or inaccurate and are provided for assistance only (no professional advice). Review before relying.

- We use third‑party model providers (e.g., Anthropic, Voyage). Where available, we opt out of model training on your data.

Acceptable Use

- Do not: violate laws; infringe IP; upload malware; probe or disrupt systems; bypass security; exceed rate limits; or misuse the Service to spam or harass.

- Do not upload highly sensitive personal data (e.g., government IDs, financial account numbers, health data) unless we’ve agreed in writing.

Plans, Billing & Taxes

- Paid plans are billed via Stripe and renew automatically until canceled. Fees are due in advance and are non‑refundable unless required by law.

- You may cancel anytime; access continues until the end of the current billing period.

- We may change prices with reasonable prior notice for future periods. You are responsible for taxes.

Confidentiality & Security

- Each party will protect the other’s Confidential Information and use it only as permitted by these Terms.

- We implement reasonable technical and organizational measures (see Privacy Policy) to protect Customer Data.

Intellectual Property

- We and our licensors own the Service, software, and associated IP. No rights are granted except as expressly stated.

- Suggestions/feedback may be used without restriction; you grant us a perpetual, irrevocable, royalty‑free license to do so.

Termination

- You may stop using the Service at any time. We may suspend or terminate for material breach, legal risk, or security reasons.

- Upon termination, we will delete Customer Data within a reasonable period, subject to legal/backup requirements. You may request an export before deletion.

Disclaimers

The Service is provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law.

Limitation of Liability

- To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages.

- Our total liability for all claims in any 12‑month period is limited to the fees you paid for the Service in that period (or $100 if you use a free plan).

Indemnification

You will indemnify and hold us harmless from third‑party claims arising from your Customer Data, use of the Service, or violation of these Terms or applicable law.

Governing Law & Disputes

Governing law and forum: California, USA.

Changes to these Terms

We may update these Terms from time to time. Material changes will be notified (e.g., email or in‑app). Continued use means you accept the updated Terms.
